The Supreme Court (SC) will resume oral arguments on Tuesday, April 28, in a case seeking clearer rules on recognizing foreign divorce decrees involving Filipinos.

Docketed as Melvin A. Baluyot v. Ma. Fe C. Antonio-Baluyot, the petition tackles how courts should treat divorces obtained abroad when a Filipino’s citizenship status changes over time.

The case involves a party who was a dual citizen at the time of the divorce, later became a naturalized foreign citizen, and eventually reacquired Philippine citizenship.

Under current law, divorce is not allowed for Filipino citizens, but courts may recognize foreign divorce decrees if proven valid under the issuing country’s laws, based on the principle of comity of nations.

The High Court’s ruling is expected to clarify both procedural and legal standards, especially in cases involving shifting citizenship.IMT
